1. Who we are

Thiqwave, Inc. ("Thiqwave", "we", "us") is a Delaware corporation with its principal address at 2261 Market Street STE 78441, San Francisco, CA 94114, United States. We build software for the settlement of fiat currencies and stablecoins. We are a technology provider, not a licensed financial institution; our Terms of Use describe this in more detail. References to Thiqwave include our affiliates where they process personal information on our behalf or together with us.

2. What this policy covers

This policy explains how we handle personal information collected through thiqwave.com, its subdomains, any sandbox, test or developer environment that links to this policy, and any email correspondence that follows (together, the "Site"). If you become a Thiqwave customer, the handling of personal information under that relationship is governed by the agreement between us, which takes precedence over this policy where the two differ.

3. Information you give us

If we begin a commercial relationship, we, or the licensed partners through which regulated activities are performed, will collect the identity and business verification information needed for know-your-business, anti-money-laundering and sanctions screening. This may include personal information about your directors, beneficial owners and authorised signatories. Where you provide information about other individuals, you confirm that you are entitled to do so and that you will make this policy available to them.

4. Information we collect automatically

When you visit the site, we and our service providers may collect technical information including your IP address, browser type, device type, operating system, referring page, the pages you view and the time you spend on them. This is used to keep the site secure and to understand which content is useful.

5. Cookies and similar technologies

We use only cookies that are strictly necessary for the Site to function. Our analytics tools measure visits in aggregate without setting cookies or building profiles of individual visitors. You can block cookies through your browser settings; blocking essential cookies may prevent parts of the Site from working.

6. Why we use your information

We use personal information to respond to your enquiry; to assess whether your requirements fit our early access programme; to plan our product, partner and corridor roadmap; to send you updates about Thiqwave and our products where the law allows, which you can opt out of at any time using the link in the message or by emailing us; to operate, secure and improve the Site; to meet legal, regulatory and compliance obligations that apply to us or to our partners; to establish, administer and enforce a commercial relationship if one begins; and to protect our rights and those of others.

7. Legal bases

Where the EU or UK General Data Protection Regulation or a similar law applies, we rely on the following legal bases: performance of a contract, or steps taken at your request before entering one; our legitimate interests in operating, securing, improving and promoting our business; compliance with a legal obligation; and consent, where consent is required and has been given. Where other data protection laws apply, we rely on the equivalent grounds available under those laws.

8. Who we share information with

We share personal information with our affiliates and with service providers who help us operate, including website hosting, email, analytics and identity-verification providers. Where a commercial relationship begins, we may share information with the licensed partners through which regulated activities are performed, and with banking, liquidity, custody and compliance partners, to the extent needed to provide the service; and with regulators, law enforcement or courts where we or our partners are legally required to do so. We may share information with our professional advisers, and with a counterparty and its advisers in connection with a financing, acquisition, reorganisation or similar transaction. We do not sell personal information.

9. International transfers

We are incorporated in the United States, and personal information may be processed there and in other countries where we, our affiliates, our partners or our service providers operate. Those countries may have data protection laws that differ from those of your country. Where a transfer is restricted by the law that applies to you, we put in place the safeguards that law requires, such as standard contractual clauses or an equivalent mechanism.

10. How long we keep information

We keep access request information for as long as needed to evaluate and respond to it, and for a reasonable period afterwards for our records. Where record-keeping obligations under financial services, anti-money-laundering or tax law apply to us or to the partners performing regulated activities, we keep the relevant information for the period those obligations require. Technical and analytics information is kept for a shorter period.

11. How we protect information

We apply technical and organisational measures appropriate to the sensitivity of the information, including access controls, encryption in transit, and segregation of production systems. No system is completely secure, and we cannot guarantee absolute security.

Information on public blockchains

Where the Services involve transactions recorded on public blockchains, information such as wallet addresses and transaction details is published to a network that we do not control. That information is public and permanent, and we cannot alter or delete it.

13. Your rights

Depending on where you are located, you may have the right to request access to the personal information we hold about you, to have it corrected or deleted, to object to or restrict how we use it, to withdraw consent where we rely on it, to receive a copy in a portable format, and not to be subject to a decision based solely on automated processing. If you are a California resident, you may additionally have the right to know what personal information we collect and how we use and disclose it, to request its deletion or correction, and to opt out of its sale or sharing. We do not sell or share personal information as those terms are defined by California law. Exercising any of these rights will not result in you receiving a lesser standard of service.

14. How to exercise your rights, and how to complain

Where the law allows, we may decline or charge a reasonable fee for requests that are manifestly unfounded or excessive.

Send you queries to support@thiqwave.com. We will verify your identity before acting on a request, and we will respond within the period required by the law that applies to you. If you are not satisfied with our response, you may complain to your local data protection authority.

14. Children

The site and our services are intended for businesses and for people aged 18 and over. We do not knowingly collect personal information from children.

15. Changes to this policy

We may update this policy from time to time. The date at the top of the page shows when it was last changed. Where a change is material, we will take reasonable steps to bring it to your attention.
