1. These terms

These terms govern your use of thiqwave.com. The site is operated by Thiqwave, Inc., a Delaware-incorporated company with a registered address at 2261 Market Street STE 78441, San Francisco, CA 94114, United States. By using the site you agree to these terms. If you do not agree, do not use the site.

2. What these terms do not cover

These terms cover the website only. Access to and use of the Thiqwave settlement platform, application programming interfaces, and any related service is governed by a separate written agreement between Thiqwave and the customer. Nothing on this site grants a right to use those services.

3. Regulatory status

Thiqwave is not currently licensed by the Central Bank of the UAE, and nothing on this site should be read as a representation that it is. Information on this site is provided for general information only and is not an offer, solicitation or invitation to acquire, subscribe for or deal in any product, service, security or financial instrument in any jurisdiction where such an offer or solicitation would require a licence, registration or authorisation that Thiqwave does not hold.

4. No advice

Nothing on this site is financial, investment, legal, tax, accounting or regulatory advice, and it should not be relied on as a substitute for professional advice specific to your circumstances. Descriptions of regulation are our understanding at the time of writing and regulation changes.

5. Forward-looking statements

Some statements on this site describe intentions, expectations or plans, including in relation to licensing, product capability, supported currencies, supported chains, corridors and timing. These are forward-looking and depend on factors outside our control, including regulatory outcomes and the availability of banking and liquidity partners. They are not commitments and they may change.

6. Early access and access requests

Submitting an access request does not create a contract, an obligation to onboard you, or an entitlement to any pricing, capability, corridor or timeline described on this site. Pilot programme terms, including any pricing described as locked, take effect only under a signed agreement and are subject to eligibility, verification and compliance checks.

7. Acceptable use

You may use the site for lawful purposes only. You must not attempt to gain unauthorised access to the site or any connected system, interfere with its operation, introduce malicious code, scrape or extract content at a scale that burdens the site, or use the site to breach sanctions, anti-money laundering or other applicable law.

8. Intellectual property

The site and its content, including text, design, graphics, logos and the Thiqwave name and marks, are owned by Thiqwave or licensed to us, and are protected by intellectual property law. You may view and print pages for your own internal business use. You may not otherwise copy, republish, adapt or exploit the content commercially without our written permission. Names and marks of third parties are the property of their respective owners and are used for identification only.

9. Third-party links

The site may link to third-party sites and resources. We do not control them and we are not responsible for their content, their availability, or their handling of your information.

10. No warranty

The site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including as to accuracy, completeness, fitness for a particular purpose, and uninterrupted or error-free operation.

To the fullest extent permitted by law, Thiqwave will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, business, data or goodwill, arising out of or in connection with your use of the site. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnity

You agree to indemnify Thiqwave against claims, losses and reasonable costs arising from your breach of these terms or your unlawful use of the site.

13. Changes

We may change these terms, and we may change, suspend or withdraw the site or any part of it, at any time. The date at the top of the page shows when these terms were last changed. Continued use of the site after a change means you accept the revised terms.

14. Governing law and disputes

These terms and any dispute arising out of them are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction. This does not affect any right you have under the mandatory law of your country of residence to bring proceedings there.
